3. Assumption of Risk
Paragliding and related aerial sports are inherently dangerous activities that carry a significant risk of serious injury or death. The Renter acknowledges this risk is present regardless of the care taken to avoid injury, and voluntarily assumes full responsibility for any risks of loss, damage, or personal injury, including death, that may result from the use of the rented equipment, whether or not caused by the negligence of the Owner or its employees and agents.
4. Renter Responsibilities
The Renter confirms they either hold a valid pilot rating, or are a student currently receiving instruction from a certified instructor and using the equipment under that instruction, and will use it only within the limits of their training and certification. The Renter will inspect all equipment before use, will not fly if any defect or damage is found, will not lend, sublet, or transfer the equipment, and will comply with all applicable HPAC/ACVL rules, site rules, and local aviation regulations.
5. Condition, Loss & Damage
The equipment is rented in good working condition. The Renter is responsible for returning it in the same condition, normal wear and tear excepted, and is financially responsible for the full cost of repair or, if unrepairable, lost, or stolen, the full replacement cost. The security deposit will be applied toward any repair, replacement, or outstanding fees before any refund is issued; the Renter agrees to pay any balance beyond the deposit within 14 days of notice.
6. Release, Waiver & Indemnification
In consideration of being permitted to rent and use the equipment, the Renter releases, waives, discharges, and covenants not to sue Deimos Paragliding, its owners, employees, and agents from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while using the rented equipment, whether caused by the negligence of the Owner or otherwise, and agrees to indemnify and hold harmless the Owner from claims brought by third parties.
7. Insurance
The Renter is solely responsible for ensuring adequate insurance coverage for personal injury and third-party liability while using the rented equipment.
8. Governing Law
This Agreement is governed by the laws of the Province of British Columbia, Canada, and any disputes are subject to the exclusive jurisdiction of its courts.
